Sentenced to death in Comanche County, Oklahoma

Date of crime:  10/12/09

Prosecution’s case/defense response: Martinez raped and killed Martha Faye Miller, and beat to death Carl Miller, as well as assaulting their son Shawn Monk.  The defense argued that Martinez was severely intoxicated and did not premeditate the murders. The defense presented mitigating evidence that Martinez was sexually molested by two family members, as well as experiencing ongoing depression and having long-term abuse of alcohol.
