Prosecution’s case/defense response: Ashby raped, beat, stabbed and strangled Elizabeth Garcia (age 21) in her apartment sometime between 7:30 p.m. December 1, 2002 and 7 a.m. December 2, 2002. Ashby was arrested after DNA evidence was used to connect Ashby to the crime. During an interview, Ashby confessed to Garcia murder.
